Under Kentucky law, insurance agents and brokers are not considered “professionals” and thus, are not subject to traditional professional liability claims. The legal duties imposed upon insurance agents and brokers are unique to this profession, along with other aspects of Kentucky law, including the applicable statute of limitations. Led by attorney and member Susan L. Maines, our attorneys have significant experience in and knowledge of these unique claims. Claims against insurance agents and brokers are often multifaceted and may well involve underlying liability claims, coverage issues, declaratory actions, “bad faith” and Consumer Protection Act claims in addition to alleged negligence by the insurance agent or broker.
